Who we are. Mark A. Purtee LLC d/b/a “Murphy Business Sales” (the “Company,” “we,” “us,” or “our”) is an independently owned and operated franchise of Murphy Business Sales. This Privacy Policy explains how we collect, use, share, and protect information when you visit our websites, contact us, or use our services related to buying and selling businesses.

Straight talk: we collect only what we need to broker deals, we don’t sell your data, and you can opt out of marketing any time.
1) Scope
This Policy covers personal information we handle through our website(s), landing pages, forms, email, A2P SMS/voice, phone calls, meetings, events, and CRM systems in connection with our brokerage services. If you interact with Murphy Business Sales corporate or other franchisees, their policies may also apply.
2) Information We Collect
Identifiers & contact: name, email, phone, address, job title, company.
Buyer qualification: industry interests, geography, budget/financial capacity, proof of funds, experience, timeline, NDA status.
Seller/listing info: business name, industry, location, high-level financials you provide (e.g., revenue/EBITDA summaries), operations, photos, timelines.
Deal docs: NDAs, LOIs, diligence materials you choose to share.
Communications & logs: emails, call/SMS logs (time/date, routing), meeting notes.
Technical/usage: IP address, device/OS, pages visited, referrers, cookies/analytics.
Payments/admin (if used): invoices and accounting records (we use third-party processors; we do not store full card numbers).
“Business contact info” can still identify a person. We treat it as personal if it can identify you.
3) How We Use Information
Brokerage services: respond to inquiries; qualify buyers; manage NDAs; present listings; coordinate showings; facilitate negotiations; provide updates.
Franchise operations: brand compliance, quality control, and required reporting to franchisor.
A2P communications: send consent-based texts/voice for reminders, document steps, listing matches, and relevant updates (see Section 6).
Legal/compliance: recordkeeping, do-not-call, fraud prevention, and enforcing agreements.
Improvement & analytics: understand demand by industry/geography, improve our site and marketing.
4) Confidentiality & Brokerage Norms
Seller confidentiality: We treat the seller’s identity and sensitive business details as confidential and disclose them to qualified buyers only after NDA and reasonable verification.
Buyer qualification: We may request proof of funds, experience, or references before releasing sensitive details.
Records: We keep reasonable records of NDAs, inquiries, and showings to protect confidentiality and meet legal/best-practice requirements.
5) How We Share Information
We do not sell personal information. We share only as needed to run the business or as required by law:
Franchisor: Murphy Business Sales (the franchisor) for lead routing, brand standards, training, compliance, and support. The franchisor processes data under its own policies.
Service providers: CRM, email/SMS, call carriers, e-signature, hosting, analytics, scheduling, accounting—contractually limited to using your info to serve us.
Deal participants (with your authorization): attorneys, CPAs, lenders, valuation/diligence providers, escrow, and similar professionals.
Legal/safety: to comply with law or protect rights, property, or safety.
Business transfer: if we reorganize or transfer our franchise, your info may transfer with appropriate protections.
6) A2P SMS/Voice (Consent-Based Messaging)
We use Application-to-Person (A2P) messaging to deliver appointment reminders, document/status updates, qualification steps, and relevant announcements.
Opt-in (how you consent):
You consent when you (a) submit a form with your mobile number and check a consent box; (b) text a join keyword or reply YES to a consent prompt; (c) verbally consent when giving your number to our team (we log consent); or (d) use a QR/short/long code that clearly discloses messaging.
What you’ll receive & frequency:
Varies by activity (e.g., new listing matches, appointment reminders, document requests, deadlines). Message & data rates may apply. Consent is not a condition of buying services.
Opt-out anytime:
Reply STOP to end. We’ll confirm and stop messaging to that number. We also honor END, CANCEL, QUIT, UNSUBSCRIBE.

Phone number handling:
We use your number only for the messaging you consented to and related brokerage communications. We do not sell phone numbers and share them only with carriers and messaging vendors needed to deliver messages and maintain compliance.
Delivery disclaimers:
Wireless carriers and platforms may delay/fail delivery. Carriers are not liable for delayed or undelivered messages.
7) “Do Not Sell or Share”
We do not sell personal information and we do not “share” it for cross-context behavioral advertising (as defined under California law). If that ever changes, we’ll update this Policy and provide an opt-out mechanism.
8) Your Choices & Rights
Marketing emails: use the unsubscribe link.
A2P texts/voice: reply STOP (see Section 6).
Access/Correction/Deletion: email [email protected]; we’ll help, subject to legal/contractual limits (e.g., records we must keep).
Do-Not-Call: ask us to add your number to our internal DNC list.
State laws (e.g., CA/CO/CT/VA) may give additional rights (access, delete, correct, limit certain uses). We’ll honor valid requests consistent with applicable law and identity verification.
9) Cookies & Analytics
We and our vendors use cookies and similar tech for site operation, analytics, and basic marketing measurement. You can control cookies in your browser; blocking some may affect site performance.
10) Data Retention
We retain information only as long as necessary for the purposes above, including legal, tax, do-not-call/SMS compliance, fraud prevention, and deal documentation. When no longer needed, we delete or de-identify information on a reasonable schedule.
11) Security
We use commercially reasonable administrative, technical, and physical safeguards to protect information. No method is 100% secure, but we work to prevent unauthorized access, use, alteration, or disclosure.
12) Children
Our services target adults involved in business transactions. We don’t knowingly collect data from children under 13.
13) International Visitors
We operate in the United States. If you access our services from outside the U.S., your information may be transferred to and processed in the U.S., where laws may differ.
14) Third-Party Sites & Platforms
Links or embeds (maps, scheduling, e-signature, lender portals, etc.) are governed by those parties’ policies. Review their terms and privacy practices.
15) Changes to This Policy
If we update this Policy, we’ll revise the Effective date and post the new version. Material changes will be highlighted for a reasonable period.
